Alexander McHardy 1707-1768

The sons surviving in 1768 of Alexander and Elspet McHardy who married in 1703  were identified by the testament and the gravestone of their son Alexander (sometimes Alester) McHardy of Tolduquhill.  This testament proven in 1768 (CC.1/6/44 items 145 to 151) names this Alexander's brothers as James McHardy in Torrancroy, John McHardy in Lochans and Hary McHardy.  On careful examination of the gravestone in Strathdon kirkyard it was apparent that Alexander died in 1768 aged 61 (not in 1786 aged 5 yrs? as published in 1989 by Alastair and Margaret Beattie)

James McHardy in Torrancroy

James, John and Harry are named in Alexander's will as his brothers german - ie of the same father - so they may be sons of a second marriage, born in the 1720s when the Strathdon OPR was defunct.  The tack (lease) of Torrincroy from Whit 1758 was made to Alaster (or Alexander) McHardy and his second son James (Aberdeen University Duff House papers MS 3175/829), and was transferred to James alone for 19 years from Whit 1766 ( MS 3175/828) and again from Whit 1782.
 Note 3 James Mchardy, son of John McHardy in Milton of Cabrach Cabrach OPR at 13 March 1786: John Mckardie in Militon of Cabrach had a son by his wife Penuel Anderson baptised, named James witnesses Alexr Anderson Esq of Candacraig & James Mckardie in Torrancroy.
The 1851 census (at 15 Woodside Crescent, Glasgow) shows James McHardy, aged 62, writer and depute sheriff clerk, born in Banff, Inveravon [adjacent to Cabrach] - and note that he was named as  executor in the will of Robert Anderson of Candacraig, nephew to Penuel Anderson above.

Jane McHardy m James Grassick

The OPR records many fewer baptisms than previously in the 1760s and Jane McHardy's birth is not recorded.  It was first assumed she belongs to James McHardy's family by proximity and the naming pattern of her children.  This was later confirmed in Aberdeen University Historic Collections MS 3402 Bundle 22 comprising evidence taken in 1865 in a commonty dispute in which James Forbes aged 75 and residing in Finnygall [whom we know to be a son of Hary Forbes and Jean McHardy] affirmed  'I have seen cattle and sheep belonging to James McHardy tenant in Torrancroy - my grandfather - pasturing in the Meikle Glenoughty.'  Supporting evidence in NAS CS 298/29/5 is that Jane McHardy's daughter's husband James Grassick provided financial surety for Alexander Farquharson in Asloun (son of Isobel McHardy above) & James McPherson (son of Diana McHardy above).

Edward McHardy

Edward's birth is noted above.  His mother is not named but the Kirk Session Register CH2 343/3 shows that his father paid a penalty of £20 as late as 6 December 1767, shortly before his will was witnessed by the Minister, and it shows Nelly McPherson of Toldachull (Tolduquhill) in a 'list of those due their penalties' at 8 December 1769.  Alexander's will bequeathed his 'backclothes' (as opposed to bedclothes) to his son Edward and, apparently for this reason, was disputed by his widow.   
 Note 2

George McHardy

George and Susan were in Strathdon in 1841 and 1851 where she died in 1856.  Daughter  Elizabeth born in 1840 and Francis in 1843.  The eldest son of George and Susan was Alexander who married Agnes Finleyson in Dundee. One of the children of Alexander and Agnes was Thomas Adamson Finlyson McHardy who married Mary Davidson.  They moved to Stockton on Tees where their daughter Mary Cameron McHardy was the grandmother of Irene Moffat (as above).

 Note 1

 Diana McHardy

 Diana McHardy, with Gustavus McPherson below, started all this.  Their marriage at Tolduquhill in 1788 appears in the OPR, but there is no record of their births or deaths.  So why was she called Diana, a name unknown in Strathdon since two named Diana Forbes were christened at the end of the 17th century.  The survivor of these married Roderick Farquharson in 1707.  According to the Broughdearg manuscript of 1737 (FQ) they had three daughters but we do not know the name of the third daughter, born in the unrecorded years after 1715.  If this was Margaret Farquharson who married James McHardy in 1753, she might have named her first daughter Diana about that time, when many baptisms were lost,  before the recorded baptism of their daughter Margaret in 1755.  Diana McHardy turns up in Glenkindie in the 1841 census with a reported age of 82 but this could have been under-recorded.    In any case her age suggests that Diana above could have been the mother of the next Diana McHardy, baptised at Tolduquill in 1781, and therefore husband of Charles McHardy who presumably died before Diana above married Gustavus McPherson in 1788.
 Note 2

 Gustavus McPherson

  So why was he called Gustavus?  The name hardly appears in the 'Given Name' index of the OPRs but Gustavus Farquharson was living in Strathdon until 1752 and had a number of illegitimate sons. So he looks like Gustavus McPherson's father.  The surname McPherson was unusual in Strathdon but common on the other side of the Ladder Hills in Strathavon.  However Nelly McPherson of Toldachull (Tolduquhill) appears in the Kirk Session Register (CH2 343/3) at 12 Dec 1769 in 'A list of those who are due their penalties'.   In the lack of any other evidence, it seems that nearly twenty years earlier she could have been Gustavus McPherson's mother?  He becomes respectable in CH2 343/4 at 5 April 1789 by renting a church pew.

Harry McHardy

Aberdeen Sheriff Court Records SC1/11/768 include a petition dated 28 September 1858 by Harry McHardy residing at Torrancroy, Strathdon presently prisoner in the East Prison of Aberdeen v his creditors.
Imprisoned 17 August due to appear in court 16 October in respect of a civil debt amounting to £46-2-0 at the instance of Thomas Riverton Esg. Advocate, Aberdeen, other creditors John Begg merchant Badenyon £7-3-0, John McHardy farm servant Semiel £8-0-0, James Wattie merchant Bellabeg £3-0-0.  'The petitioner is unable to pay his debts and is ready to surrender his whole means and estate for benefit of his creditors.  His inability to pay his debts has not been occasioned by fraud but has arisen solely from misfortunes and losses.'  Process of Cessio Bonorum [applied for ?] trustee named Wm Watson.
